These Terms of Service ("Terms") govern your access to and use of www.fugeesfamily.org and other webpages that link to these Terms (collectively, the "Website"), which are operated by Fugees Family, Inc. ("Fugees Family," "we," "us," or "our").
By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website. Additional terms, releases, applications, program agreements, donation terms, employment terms, or third-party terms may apply to particular services or transactions. If additional terms conflict with these Terms, the additional terms control for that specific service or transaction.
1. Purpose of the Website
Fugees Family is a nonprofit organization advancing educational opportunity for refugee and immigrant youth. The Website provides information about our mission, programs, partnerships, resources, events, employment opportunities, fundraising, donations, and related activities.
2. Educational, Immigration, and Other Informational Resources
Content on the Website is provided for general informational and educational purposes. Although Fugees Family may publish resources relating to schools, multilingual learners, refugee and immigrant families, immigration enforcement, public policy, or other important topics, Website content is not legal advice, immigration advice, tax advice, financial advice, medical advice, or a substitute for advice from a qualified professional.
Laws, policies, agency practices, and circumstances can change quickly. You are responsible for evaluating information before acting on it and for obtaining appropriate professional advice when needed.
3. Eligibility and Use by Minors
The Website is intended for a general audience, including educators, families, supporters, partners, and community members. Fugees Family also serves youth through its programs. If you are under 13, you should use the public Website with a parent or guardian and should not submit personal information through a general Website form unless an authorized Fugees Family process specifically permits it and any required permission has been obtained.
4. Permitted Use and Prohibited Conduct
You may use the Website only for lawful purposes and in accordance with these Terms. You agree not to:

- Circumvent security measures, attempt unauthorized access, probe or test vulnerabilities, introduce malware, or interfere with servers, networks, databases, or systems connected to the Website.
- Use Website content or services in a way that infringes, misappropriates, or violates intellectual property, privacy, publicity, or other rights.
- Use the Website to harass, threaten, exploit, defraud, or harm another person.
- Use the Website in violation of applicable federal, state, local, or international law.

If you submit information, feedback, ideas, testimonials, photographs, materials, or other content through the Website, you represent that you have the right to provide it and that doing so does not violate the rights of another person. Any specific release, consent, license, or program agreement presented when content is submitted will govern our use of that content.
Please do not submit confidential, privileged, highly sensitive, or legally protected information through a general Website contact form unless we specifically request it through an appropriate process.
7. Donations and Payments
Donations and other payments may be processed through third-party payment providers. By making a transaction, you agree to provide accurate information and authorize the applicable processor to charge the selected payment method. Third-party processor terms and privacy policies may also apply.
Unless otherwise stated at the time of the transaction, donations are generally final, subject to applicable law and our ability to correct processing errors. If you believe a donation was made in error, contact us promptly. Information about tax deductibility is general only; you should consult your tax advisor regarding your individual circumstances.
If you authorize a recurring donation, charges may continue at the frequency you selected until you cancel using the method made available by Fugees Family or the applicable payment provider.
8. Products, Partner Offers, and Third-Party Services
The Website may link to products, fundraising campaigns, partner services, employment systems, social media platforms, payment services, or other third-party websites. Some products or services may be offered or fulfilled by third parties rather than Fugees Family. Third-party terms, pricing, return policies, warranties, and privacy practices apply to those third-party services. A link or reference does not necessarily constitute an endorsement.
9. Email and SMS Communications
If you sign up for email or SMS communications, you agree to receive messages consistent with the consent you provide. You may unsubscribe from marketing emails using the unsubscribe link in the message. For SMS, message and data rates may apply, message frequency varies, and you may reply STOP to opt out or HELP for assistance. Consent to receive marketing or promotional texts is not a condition of making a donation or receiving services.

Our collection and use of personal information through the Website are described in our Privacy Policy, which is incorporated into these Terms by reference.
11. Website Availability, Accuracy, and Changes
We work to keep Website information useful and current, but we do not guarantee that the Website or any Content will always be available, complete, accurate, current, or error-free. We may add, remove, suspend, or change Website content, features, programs, resources, opportunities, or links at any time without notice.
12. No Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." FUGEES FAMILY DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FUGEES FAMILY AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, VOLUNTEERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF FUGEES FAMILY ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED THE AMOUNT, IF ANY, YOU PAID TO FUGEES FAMILY FOR THE SPECIFIC WEBSITE-BASED SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
Some jurisdictions do not allow certain warranty disclaimers or limitations of liability, so some limitations above may not apply to you. Nothing in these Terms limits liability that cannot legally be limited.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Fugees Family and its directors, officers, employees, and agents from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Website, your violation of these Terms, or your infringement of another person's rights.
15. Intellectual Property Complaints and DMCA Notices
We respect the intellectual property rights of others and respond to properly submitted notices of alleged infringement.
If you believe in good faith that material on the Website infringes your copyright or other intellectual property rights, send a written notice titled "Infringement of Intellectual Property Rights - DMCA" that includes:
1. A physical or electronic signature of the person authorized to act on behalf of the owner of the right allegedly infringed.
2. Identification of the copyrighted or other protected work claimed to have been infringed, or a representative list if multiple works are covered by one notice.
3. Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it, including the relevant URL when available.
4. Your name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that the disputed use is not authorized by the rights owner, its agent, or the law.
6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner of the right or authorized to act on the owner's behalf.

16. Governing Law, Venue, and Class Action Waiver
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Any controversy or claim arising out of or relating to these Terms or the Website shall be brought in a court of competent jurisdiction located in Franklin County, Ohio, unless applicable law requires otherwise.
TO THE EXTENT PERMITTED BY LAW, YOU AND FUGEES FAMILY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
17. Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Our failure to enforce a provision is not a waiver of our right to enforce it later.
18. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Website after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
19. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms that apply to a specific service or transaction, constitute the agreement between you and Fugees Family regarding your use of the Website and supersede prior Website terms on the same subject.
